Body-Worn Camera Video Release of Officer-Involved Shooting

Charlotte, N.C. – (Tuesday, May 23, 2023) – Today, the Charlotte-Mecklenburg Police Department (CMPD) released body-worn camera (BWC) video of an officer-involved shooting involving officers and an armed subject that occurred on June 26, 2022. This footage was court-ordered for release following a petition.  

 

On Sunday, June 26, 2022, shortly before 1 p.m., officers responded to an armed robbery call for service on Tuckaseegee Road, regarding a suspect stealing groceries from a Food Lion. The suspect brandished a firearm during the incident. Officers encountered the suspect nearby on Tuckaseegee Road, based on the description of the suspect and items noted on the call.

 

When officers approached the suspect, later identified as Kevin Boston (DOB 11/21/1976), Mr. Boston pulled out a firearm. Officers took cover and gave commands for him to drop the weapon. Mr. Boston did not comply and continued to walk down the street with the gun in his hand. Officers perceived an imminent deadly threat and discharged their service weapons. Mr. Boston was struck by the gunfire. Mr. Boston also fired at officers, and several of his rounds struck CMPD patrol vehicles. When safely able to do so, officers moved to take Mr. Boston into custody and render emergency aid. Mr. Boston was transported to the hospital where he was pronounced deceased. The firearm used by the suspect in this incident was recovered on scene.

            

The North Carolina State Bureau of Investigations (NCSBI) conducted the criminal investigation into this officer-involved shooting. The CMPD Internal Affairs Bureau conducted a separate but parallel investigation and determined the officers did not violate any CMPD policies. The Mecklenburg County District Attorney’s Office also reviewed the case and has issued a letter explaining that they will not prosecute officers involved in this shooting.

 

The initial information released by CMPD following the incident stated that the suspect fired upon officers first, after which officers returned fire. At the conclusion of the investigation, CMPD cannot definitively state that the suspect fired first. However, this does not change the fact that officers perceived an imminent lethal threat and acted appropriately to defend their lives and the lives of others in the area.

Case Update: Officer-Involved Shooting in the Freedom Division

 

Charlotte, N.C. – (Monday, June 27, 2022) – The suspect in this case has been identified as Kevin Boston (DOB 11/21/1976). The suspect was pronounced deceased at the hospital from his injuries on June 26, 2022, at around 4:38 p.m.

 

The investigation into this case is active and ongoing. The North Carolina State Bureau of Investigations (SBI) is conducting the investigation. As additional information develops, it will be released by the CMPD’s Public Affairs Office. Officer-Involved Shooting in the Freedom Division

 

Charlotte, N.C. – (Sunday, June 26, 2022) – The North Carolina State Bureau of Investigation (SBI) is conducting a CMPD officer-involved shooting investigation near the 5100 block of Tuckaseegee Road in the Freedom Division.

 

On Sunday, June 26, 2022, shortly before 1 p.m., officers responded to an armed robbery call for service on Tuckaseegee Road. Based on the description of the suspect and items noted on the call, officers encountered the suspect at a location nearby.  The suspect discharged a firearm multiple times at officers, striking at least one patrol vehicle. At that point, officers returned fire and struck the suspect. A firearm was recovered on scene. A photo of that firearm is included with this release.

 

No officers were injured. The suspect was transported by Medic with life-threatening injuries. 

 

Representatives from CMPD’s Operations Command, Victim Services, Peer Support, and CMPD’s Behavioral Psychologist also assisted. The SBI is leading the investigation. CMPD Internal Affairs will conduct a simultaneous, parallel investigation.
